Nurse lost sight in one eye after patient assault

A patient is accused of grievous bodily harm after a nurse he punched lost the sight in one eye. According to the Liverpool Echo, the 49 year old patient attacked staff at the Scott Clinic in Rainhill, on July 20, 2010, biting and punching people who tried to restrain him.

David Polglase, prosecuting, told jurors: “While members of staff were present the defendant started to become irate and abusive.

“He wasn’t able to be calmed down despite the intervention of staff and punched a member of staff, Mark Birch, to the face.

“That prompted members of staff to try to restrain Mr Fitzgibbon as they were entitled to do.

“During the incident, the prosecution say, the defendant bit a member of staff, Mr Steve Davis, and punched him in the right eye.

“The punch caused him to lose the sight in his right eye.”

Steven Davis, who no longer works in the clinic due to his injury, told the court Fitzgibbon started shouting abuse and saying that he shouldn’t be there.

Fitzgibbon, of no fixed abode, is charged with causing grievous bodily harm to Steven Davis and assault occasioning actual bodily harm to Sean White.
